Moratorium on CMS Regulations

The U.S. House voted 416-12 on June 19 to pass a supplemental appropriations bill with an amendment containing moratoria until April 2009 on six CMS Medicaid regulations. The Senate is considering the legislation this week. The White House has said that the President will sign it. If enacted, the moratorium would preserve Medicaid funding for case management, rehabilitation services, school-based Medicaid administrative and transportation claiming, and hospital-based graduate medical education. It would also delay restrictions on reimbursement of public providers and use of provider-related taxes to fund state expenditures. The moratoria would enable a new Administration to reverse the funding restrictions.
